1. Scope of Application
These Terms and Conditions (hereinafter "Terms and Conditions") apply to the use of PV Valuator PRO as well as to the purchase and use of paid credits and digital services through the website www.pv-valuator.de .
PV Valuator PRO is a web-based application for the professional technical and economic valuation of photovoltaic systems.
These Terms and Conditions apply to all customers unless expressly agreed otherwise.

3. Scope of Services
PV Valuator PRO provides digital functions for the technical, economic and financial analysis of photovoltaic systems.
Depending on the selected scope of services, the following services may in particular be offered:
- technical analysis of photovoltaic systems
- income-based valuation analysis
- residual value analysis
- financial profitability analysis
- calculation of NPV, IRR and payback period
- PVGIS-based yield analyses
- generation of digital PV valuation reports
- generation of professional PV valuation reports
- other digital services offered within PV Valuator PRO
The specific scope of services is determined by the Credit Package selected and displayed at the time of purchase as well as by the services described within the application.
4. Credits
Certain paid functions of PV Valuator PRO are accessed through digital credits.
The number of credits required is displayed within the application before the corresponding service is used.
The available credit packages may include, in particular, the following amounts:
- Starter: 10 credits
- Professional: 25 credits
- Expert: 50 credits
- Business: 100 credits
The offer displayed at the time of purchase shall be decisive in each case.
5. Prices and VAT
The current prices of the credit packages are displayed on the website or during the payment process.
Where required by law, statutory VAT will be charged additionally and shown accordingly during the payment process.
The prices displayed at the time of conclusion of the contract shall apply.
6. Ordering and Conclusion of Contract
The presentation of credit packages on the website constitutes an invitation to submit an offer.
By selecting a credit package and completing the payment process, the customer submits a binding offer to purchase the selected package.
The contract is concluded once the payment has been successfully confirmed and the purchased credits have been credited to the customer's account.
7. Payment Processing
Payment processing is carried out via Stripe and the payment methods offered there.
The payment methods available in each individual case are displayed during the payment process.
Payment processing and, where applicable, refunds are processed through the respective payment service provider.
8. Provision of Digital Services
PV Valuator PRO is provided as a web-based digital service.
Following successful payment confirmation, the purchased credits are credited to the customer's account and may be used within the scope of the respective offer.
Use of PV Valuator PRO requires a suitable web browser and a functioning internet connection.
9. Use of Credits
Credits may only be used for the services provided within PV Valuator PRO.
Credits are not freely transferable and cannot be exchanged for cash or other means of payment unless otherwise required by law.
Misuse of credits is not permitted.
10. Customer Account and Access Credentials
Where a customer account is required for use, the customer is obliged to keep their access credentials confidential.
The customer must inform Apps For Green immediately if there is reason to suspect unauthorized use of the customer account.
The customer is responsible for actions carried out under their customer account insofar as they are responsible for such actions.
11. Permitted Use
The customer undertakes to use PV Valuator PRO exclusively in accordance with applicable laws.
In particular, it is prohibited to:
- use the application for unlawful purposes;
- circumvent technical protection measures or access restrictions;
- allow unauthorized third parties to access the customer account;
- intentionally or improperly overload the technical infrastructure;
- copy, modify or redistribute the software or parts thereof without appropriate authorization.
12. Calculation Results and Valuation Reports
The calculations, analyses, value indications, forecasts and reports generated by PV Valuator PRO are based on the data entered by the customer as well as the calculation models and data sources used in each case.
The customer is responsible for checking the completeness and accuracy of the data entered.
The results are intended for technical and economic analysis and decision support.
In particular, PV Valuator PRO does not constitute legal advice, tax advice, financial advice or a binding real estate valuation.
The calculation results do not constitute a guarantee of future yields, market values or economic developments.
13. External Data Sources
Certain functions of PV Valuator PRO may rely on external data sources or services.
The availability, accuracy and timeliness of external data may depend on third-party providers.
To the extent permitted by law, no guarantee can be given that external services will be available at all times.
14. Technical Availability
Apps For Green endeavors to maintain the highest possible availability of PV Valuator PRO.
However, uninterrupted availability cannot be guaranteed at all times.
Temporary restrictions may arise in particular due to maintenance work, technical faults, security measures or disruptions affecting external service providers.
15. Copyright and Rights of Use
All rights to the software, source code, design, calculation models, data structures, texts, graphics and other content of PV Valuator PRO remain, unless expressly stated otherwise, with Apps For Green or the respective rights holders.
The customer is granted only the right to use the purchased functions within the contractually agreed scope.
Reproduction, redistribution, rental, publication or other commercial exploitation of the software itself is not permitted without prior consent from Apps For Green.
16. Rights in the Event of Defects
The statutory rights regarding defects shall apply.
For digital products and digital services, the applicable statutory provisions shall apply in particular.
The customer's statutory rights are not restricted by these Terms and Conditions.
17. Liability
Apps For Green shall be liable in accordance with statutory provisions.
Liability for intent and gross negligence as well as for damages resulting from injury to life, body or health shall not be excluded or limited.
Liability under mandatory statutory provisions remains unaffected.
To the extent permitted by law, Apps For Green shall not be liable for damages resulting exclusively from incorrect or incomplete information provided by the customer.
18. Refunds
Refunds are governed by the separate Refund and Return Policy of PV Valuator PRO.
The customer's statutory rights remain unaffected.

19. Right of Withdrawal for Consumers
Consumers generally have a statutory right of withdrawal where the legal requirements are met.
Special statutory provisions may apply to digital content and digital services regarding the expiry or exercise of the right of withdrawal.
In particular, the right of withdrawal may expire under the statutory requirements if performance of the digital service begins before the withdrawal period has expired, after the consumer has expressly consented and confirmed that they are aware of the legal consequences.
Where a statutory right of withdrawal exists, the applicable statutory provisions shall remain fully applicable.

21. Changes to the Services
Apps For Green may further develop PV Valuator PRO technically and improve, supplement or modify functions.
Changes may not unreasonably impair the primary contractual service owed.
The customer's statutory rights remain unaffected.
22. Changes to These Terms and Conditions
Changes to these Terms and Conditions shall only be made within the scope permitted by law.
For contracts already concluded, the conditions agreed at the time the contract was concluded shall generally apply, unless otherwise permitted by law.
23. Applicable Law
The law of the Federal Republic of Germany shall apply.
With respect to consumers, this choice of law shall apply only insofar as it does not deprive them of the protection provided by mandatory provisions of the country in which the consumer has their habitual residence.
24. Place of Jurisdiction
For consumers, the statutory rules on jurisdiction shall apply.
For businesses, Munich shall be the place of jurisdiction to the extent permitted by law.
